MPUMALANGA – Gerhard Kolesky (58) and Jacob Zongezile Bholosha (53) along with a juristic person (company) called “GK Steel Profiling” appeared before the Middelburg Regional Court on Monday, 15 March 2021.

They were charged with 125 counts of contravention of Pension Fund Act 24 of 1956. These charges were linked to the failure to pay the employees Contributions to the Metal Industries Provident fund meant for their pension fund after deduction.
The total amount of R198 317.83 was not paid over a period between December 2006 and February 2010. Consequently a case against the trio, a company owner, juristic person and a director was reported to the authorities in October 2019 and referred to the Hawks Serious Commercial Crime Investigation.

The company paid a total of R297 897.15 including the interests in September 2020 on a civil claim parallel criminal investigation. Subsequently the Middelburg Regional Court acquitted the company owner and director on all charges and further fined the company R100 for each of the 125 counts of charges which amounted to an additional R12 500.
